With the innovation and development of the online world, the phenomenon ofcyberspace criminal is becoming increasingly severe, especially in which the helpingconduct of internet intermediary providers participate in people who is in theimplementation of acts endangering legal interest to serious condition. It has not onlyseriously jeopardized the harmonious development of cyberspace, but impacted thetraditional theory of criminal law and judicial practice. This article, first, clarifies thesubjects with criminal liability for network services based on a classification ofnetwork intermediary service providers. Then it focuses on the lack of penalization,jeopardization and accountability of network intermediary service providers helpingin cyberspace by using the Sided accomplice’s legislation through a specific analysisof the alienated traditional criminal law theories of accessory offenders. In the lastpart, this paper proposes a way to solve this problem so as to increase criminalprotection and create a cool and bright cyberspace.
