Science and technology is becoming the core competitiveness in the internationalmarket,the international community pay more and more attention to the protection ofexisting technology at the same time in encouraging innovation。With the accelerationof the process of internationalization, the protection of patents States has not onlylimited to domestic, but as much as possible to protect their own interests in a widerrange of domestic law as well as by a series of bilateral and multilateral internationalagreement. As one of the state owning the most developed patent system in theworld,thepantent system of united states must pose significant impact to formationand development of the international patent system. So it is necessary to researchinternational patent protection institution, in particular to study U.S. patent protectionsystem.Though started lately, Chinese patent system develop rapidly in recent years,especially in domestic patent development. The number of Chinese patentapplications for invention has ranked first for3consecutive years in the worldaccording to data released by SIPO,2013.However, compared with the boomingdomestic patents our overseas patent protection is relatively slow,which is a fatalmishap to own development in the economic globalization era.This is the first thesis researched U.S. patent system on the whole since thepromulgation of the America Invents Act. The thesis analyze the domestic and foreignpatent policy of America aiming to enable the reader to understand the U.S. patentprotection rules systemically and help solve the problem of America Patent Law andinternational patent law. This thesis consists of three parts: Chapter1of the thesisanalyzed the entity and procedure of the Amercia patent law and history of patentprotection system. Chapter2of the thesis analyzed the USA foreign trade pretectionstrategy、“section337”、“Special301”.Chapter3of the thesis makerecommendations to Chinese patent protection system combined domestic and foreignlegislative experience.
