A Study On The Legal System Of Domestic Labor Compensation

Due to the direct beneficiaries of housework is laborer themselves and theirfamilies, so long housework is treated as a family in the internal affairs, its economicvalue has been ignored by people. Chinese2001"Marriage Law" article40for thefirst time acknowledged the right to compensation housework. This has very positivemeaning for maintaining engaged in housework in the family party, especially womenparty right and interests. But the housework compensation system in "Marriage Law"is still not completely, system construction is too general, functioning of the judiciaryperformance is not enough. The right to compensation for housework as main objectof this paper, using the method of theoretical research and questionnaire survey,analysis of related issues, put forward suggestions to improve legislation.The paper first chapter introduces the problems related to the housework and themain content of housework compensation system in our country. The second chaptersimply introduces and analyses the foreign related legal system, hope for somereference to the research of our country in the same problem. The third chapteranalysis of the condition of right to compensation housework, from the houseworkcompensation standard and value quantization to study the housework compensationdifficulty in practice, on the basis of theoretical analysis, put forward the limitation ofour country on this issue. The fourth chapter combined with the content of the before,put forward some specific suggestion to make progress housework compensationsystem in China.
