In criminal proceeding, criminal physical examination is a special inspection ofthe body, a series of activities are directed against third person and prosecuted person.Its purpose is to identify the victim, criminal suspects’ appearance, color, specialmarks, injured parts and other physiological status, which facilitates theidentification of cases, finding the crime fact. This dissertation’s train of thought,taking the legal improvement in the system of criminal physical examination as themain line, around three key problems-theoretical basis, current practice, perfectdesign. I will analysis feasibility and necessity of improvement in the criminalphysical examination, from a tiny starting of the criminal system, in order to find theperfect of system.This dissertation is mainly analysis conception and nature of criminal physicalexamination from the basic starting. By defining the characteristics and classificationof criminal physical examination, we can distinguish the difference between thecriminal physical examination and the similar criminal measures. The second Partanalyses legislation and practice, through the extraterritorial criminal investigation ofcivil law and common law systems in major countries and regions, from thisanalyses to find reference about our country. The three part analyses criminalphysical examination of our country from legislation and practice of justice. Infourth part, the author combines the useful experience of foreign countries and ournational condition，and provides the advice of improvement from the start ofcriminal physical examination, implementation and enforcement.About the perfect of system, this dissertation is discussed from four parts: usingthe three principles guiding our criminal physical examination legislation; in thelegislation, dividing our criminal physical examination; Improvement of procedure;consummating the ancillary system.
