A Study On The System Of Adults' Admission In China

The appropriate adult participation system that introduced from the foreigncountries is a relatively new system in our country, which emerged with thedevelopment of the juvenile justice. It has been established in the juvenile criminalproceedings when the criminal procedure law of our country was amended in2012.This paper is divided into three chapters:The first chapter is an overview of the appropriate adult participation system，including the following contents: the definition of the appropriate adult participationsystem and its theoretical basis, the features of this system in the criminal procedure,in addition, the significance of this system.In the second chapter, we analyze the problems of the appropriate adultparticipation system of our country. During the process of analyzing the cases thatwere involved in this system in the grass-roots court of our country and the practice ofit in many areas, we find that there is a good development trend of this system.Because of the different situation, the development of the system diversified, whichresults in different implementation of it. There is valuable experience, meanwhile,many problems emerged. We summarize the problems that are in common during thepractice.In the third chapter, we put forward suggestions to specify the appropriate adultparticipation system according to the problems that mentioned above. The measuresare as the followings: trying to improve the corresponding laws and regulations,establishing a unified national appropriate adult management institution, making aunited national selection standards of appropriate adult, enduing the minor criminalsuspects and the accused with rights to choose appropriate adult, expanding the stageand range of the participation of appropriate adult, strengthening the supervisorymeasures of the appropriate adult participation system.
