On The Perfection Of The Appropriate Adult Participation System

Because minors special physiological and psychological characteristics,China's juvenile justice education probation minors,minors involved in crime to ensure the judicial justice for the purpose of making the juvenile justice system highlights the education of minors,reform and save.The appropriate adult participation system is a special safeguard minors enjoy the rights and interests of minors lawsuit procedure system,in order to transfer the case not related to third party involved in juvenile criminal procedure,the function of the appropriate adult,such as the maintenance of crimes involving minors' rights and interests,promote exchanges between the two sides questioning procedural justice,supervision etc..The new criminal procedure law in the form of legal provisions in the judicial practice of the appropriate adult system mode to be determined,marking China's appropriate adult participation system by practice stage into the theoretical construction stage is a great progress of the juvenile justice system.But there are still many deficiencies in legislation and judicial practice.Therefore,it is necessary to conduct academic research on system of appropriate adult participation system,the real break the plight of the appropriate adult participation system,perfecting the system of appropriate adult participation system.This paper is divided into three parts.The first part is mainly about the connotation of the appropriate adult participation system,analyses the theoretical basis and value of proper adult participation system,the appropriate adult participation system abroad to do a comparison,the article introduces the characteristics of the appropriate adult participation system of foreign typical countries.The second part analyzes the present situation and the existing problems of the suitable adult participation system in our country.In the second part of this paper,based on the appropriate adult participation system perfect,in the fourth part the author put forward the suggestions for improvement,in order to promote the appropriate adult participation in the legislative and judicial interpretation of the perfect process,standardize judicial practice.
