As we know, the privacy is the thing that we are not willing to tell others or noteasy to tell other people. As a human basic right that right of privacy withoutencroachment is a basic requirement for human. With the development of the rapidmodern science and technology and a sense of democracy. In order to safeguard thedignity of the individual, people protect the personal privacy requirements morestrongly, but in reality a lot of serious violations of the privacy of citizens behavior isa serious impact on our security, and the ways and means are more diversified, it notonly violates the right of privacy individual citizens, but also threaten the personalproperty security, social management order and even public security. So it has beenunable to effectively protect the privacy of citizens by civil, criminal ways. Thecriminal law as a final barrier defense system of society, it should give the necessaryattention to the privacy of citizens. However, from the perspective of criminallegislation, our country criminal law on privacy protection is far from enough to meetthe need of social reality and judicial practice, and the situation of the protection isalso not optimistic. Therefore, firstly this paper discusses problem from the basictheory of criminal law protection of the right of privacy, secondly, it discusses currentsituation of criminal law protection of privacy of the analysis, and points out theshortcomings relating to our country the criminal law, and then combines with theadvanced foreign legislation mode, aiming at the problems to put forward a improvedproposal.People is the "cell" in the society, the harmonious development of the society isbased on human rights which can be fully based protection, criminal law protection ofprivacy is the protection of basic human rights, but our country’s criminal law onprivacy protection is just passable, therefore, this article suggests, must increase thecriminal law protection about privacy. The criminal law protection of privacy has astrong legislative and practical significance.
