P2P lending platform originated from Britain Zopa,It is A new mode of financialbusiness which incorporating private lending and Internet technology. It due to thestrong market demand, It can ease the difficult problem of small businesses andindividuals that they are difficult to borrow money from the bank. And manyinvestors find a Investment Channel. Since the establishment of “ppdai” which isthe first P2P network platform of the our country, P2P industry has developed rapidlyand their size also increase sharply. The problems and risks exposed during theperiod have received more and more attention. In this paper, from the definition, thebackground to the development of a tracked, and lists the different types of P2P modelboth at home and abroad, finally through the analysis of the legal relationship of itsembedded suggest perfecting the supervision and risk, aims to contribute to thehealthy and standardizing development for its strengthen.This article is divided into five parts altogether, the first part is the introductionto the basic theory of P2P lending platform, including its basic connotation,background and development status, at the same time for different types of P2Pplatform operation mode domestic and abroad, borrowing the process and so on. It hascarried on the detailed analysis and introduction. The second part is to introduce theP2P network platform to the legal issues of loan, on the basis of analyzing theconcrete situation in our country to explore its legal nature, and to explore the legalrelationship involved. The third and the fourth part is the P2P network platformcontains the loan in China after make analysis and investigation on the legal risks,legal norms for P2P industry regulatory suggestions are put forward. The last is thesummary of the research of this paper, combing the author’s research train of thought.
