The credit business of commercial banks is the core business of commercial banksand the main source of profit. The healthy development of the credit business ofcommercial banks is directly related to the business benefits. However, because of thecredit preference of commercial banks, disorderly competition of folk loan, and thesoft constraints SME Promotion Law, commercial banks excessive pursue the largecredit business, which leads to the structure of the credit business of commercial bankin our country is not reasonable. As a result, the credit business of commercial bank isaffected negatively.The "Twelfth Five Year Plan" In2010, the party "Eighteen report in2012", andthe central economic work conference in2013, all made specific provisions of ourbank credit business. Steady advance of the interest rate and exchange ratemarketization reform, support for the private capital into the financial sector, andimprove of financial supervision are imperative.This paper attempts from three point of view, research on legal issues ofdevelopment of commercial bank credit to small and medium sized enterprises andput forward some concrete suggestions. The full paper contains three chapters. Theintroduction part, summarizes the significance of the topic, analyses the presentresearch situation about this problem, the innovation, research methods, researchstatus about the problem and deficiency. The first chapter talks about the basic modeand the development situation of China’s commercial bank credit to small andmedium sized enterprises, especially the "Credit factory" mode. The second chaptertalks about the three main problems, credit preference of commercial banks,disorderly competition of folk loan, and the soft constraints SME Promotion Law. Thethird chapter suggests for our country commercial bank credit business of small andmedium sized enterprises development.
