Study On Crime Of Traffic Accident

In recent years, the transportation industry with the development of the nationaleconomy in our country has obtained the proud achievement. But the development oftransportation industry in bring convenience to people at the same time, the lossescaused by traffic accident also not allow to ignore. Across our country each year about4.2million times the traffic accident, and the number of casualties more than200000people, including deaths account for about one5of the number of dead and injured.Because our country current "criminal law of the People’s Republic of China(hereinafter referred to as the" criminal law ") for the regulation of traffic accident stillhas defects and drawbacks, lead to inconsistent criterion for the conviction of cases inthe judicial practice. This article mainly from the traffic accident crime subject animpostor criminal responsibility cognizance and surrendered after the traffic accidentand traffic accident escape after these three aspects to analyze the legal problems in theapplication of traffic accident crime in our country, first lists the academic theoreticalcontroversy about these issues, and then to analyze these problems, finally it isconcluded that the current law on traffic accident should be perfect.
