Discussion On The Feasibility And Related Legal Problems Of Doctors' Practice

Tight relation between doctors and patients,expensive and difficulty medical treatment are an important issue which is related to harmonious society. Facing the problem of shortage of medical staff, uneven distribution of medical resources and unreasonable medical institutions operating mechanism, the great idea of multi-physician practice emerged. Health department pointed in2009, multi-physician practice means physicians can engage in two or more medical institutions, but does not include consultation of doctors. That means the phenomenon of doctors work outside is from unreasonable going to standard, reasonable and transparent. However, due to lack of legal norms, the new system is difficulty to carry out. This problem which is related to law is should be cause for concern..The paper "Feasibility of multi-physicians practice and related legal regulation" solve this problem in two aspects:on the one hand, by comparison with the crime of illegal medical practice and the crime of medical accident to make clear feasibility of multi-physicians practice, it means that multi-physicians practice do not constitute the crime of illegal medical practice;on the other hand, the author throw out a suggestion by understanding relevant laws and regulations, it suggests that medical liability for multi-physicians practices can through assume medical liabilities through different types of multi-physicians practice. At last, the author suggests that we can add physician practice risk insurance and patients with accident injury insurance.
