A Study On The Legal Management Of Floating Population In China

Along with the rapid pace of Reform and Opening, the formidable reform force and the crucial transformation of economic system promote the progress of "social revolution" in China’s urbanization, weaken the structural function of dual management system in the medium of urban and rural household registration theoretical support and innovative research on the resettlement and status reformation of hundreds of millions of migrant population, grasping the changing rules of the floating and make the population flow active. At present, China is on the way of population urbanization, in which we are in great need of the population. On the one hand, the population flow indeed brings the powerful force and the "demographic dividend" advantage. On the other hand, the increasing number of the population flow brings huge pressure to government services and management functions, and even cause the complexity, sensitivity source sex problem on city management. The effect of population management is greatly related to the long-term security of the whole nation, thus it is in urgent need of the comprehensive analysis of the special social group.Fo-shan is a representative city in the national population management. Through the overview of the status, characteristics, development trend and the criminal circumstances, as well as the service management and investigation of the floating population’s information verification, entry data and safeguard public service, this paper makes an analysis on the drawbacks existed in the management of the population flow, such as unsatisfactory performance, poor employment, difficult in fusion, leading them to be the crime mainstay. Meanwhile, as the main body of social management in face of the floating population, government presents some problems, such as the unclear mainstay, fuzzy responsibility, backward management and low efficiency when dealing with the management of floating population. Besides, the government does not carry out any effective guidance to fix up the crime causes of floating population or adopt any legislative measures to deal with those problems. Furthermore, the dislocation in legislation ideas of floating population’s management, the absence of relevant laws and the offside of management modes show the practical significance of the research on the administration of floating population in urban areas.Referring to the orderly management of floating population in advanced countries and combined with the practice of service management of floating population, this paper regards the protection of the rights and interests of floating population as the starting point and the foothold, explores the control1mode of urban crime, strengthens the legal system, perfects the system of legal publicity and education, straighten out the service management of floating population, implement the legal supervision and responsibility, and them studies and formulates the feasibility of National Floating Population Administration, which aims at regulating the behavior of floating population and protecting their rights and interests on a more scientific and orderly orbit to realize the transformation from the floating population to citizens under the background of social transition and the new town and to strengthen their sense of urban belonging.
