Procedural Retrial

The11th National People’s Congress in August31,2012have passed the "about modifying the<civil procedure law of the People’s Republic of China> decision", the current civil procedure law article200constitutes the provisions of the civil retrial causes, including the fourth, the fifth, the seventh to the eleventh are all on the regulation of procedure retrial reason.In the judicial practice in recent years, quite a part of the civil retrial procedure is started by programmed retrial reason, it has played a positive and important role to protect the litigation rights of the parties and safeguard the civil judicial procedural justice.However, we still need to further discuss how to grasp the elements,status and value of the various programs, the corresponding program specification is also needed.The relationship between procedural retrial reason and civil retrial reason will be analyzed in the first chapter, classifying procedure retrial reason.The second chapter of the paper analyze the civil procedural retrial reason in the horizontal and vertical comparison. And the third chapter is the key chapter of the paper, to do action for retrial procedure in the judicial practice by understanding and analysis on the application of the procedural retrial cases in the judicial practice.
