Choice Of Trade Remedy Mode Under Regional Trade Agreement

The regional economic and trade cooperation are popular worldwide. Many regional trade agreements are signed between countries, including China. Trade remedy measures play an important role in regional trade agreements. It not only promotes the normal and orderly development of regional trade agreements, but also protects the global trade environment by providing fair protection for the members of the region. There are three types of trade remedy measures. Which respectively are anti-dumping, countervailing and measure of safeguard. Anti-dumping measures are the most frequently used relief measures for the members of regional trade agreements. China suffered most anti-dumping investigations. A number of anti-dumping measures to China which adopted by other countries affected China’s foreign trade seriously. This paper aims to study the selection of anti-dumping remedy mode when China is signing regional trade agreements with other countries. It can help to protect our legitimate rights better and avoid the unfair treatment from member countries.Firstly the paper introduces the current circumstances in signing regional trade agreements of many countries, to reflecting the current background; Then it puts forward some problems after China signing the regional trade agreements to highlight the importance of choosing the right trade remedy mode; Third, the paper introduces the concept and types of regional trade agreements and trade relief measures. It introduces the concept of anti-dumping, countervailing and safeguard measures and related WTO specific rules in detail; Fourth, it introduces several trade relief modes of international anti-dumping, including fully retain the rights and obligation of "Anti dumping agreement", add%modify or develop "Anti dumping agreement", not apply anti-dumping. Fifth, it analysis which anti-dumping remedy mode should be selected in regional trade agreements of our country, and consider five factors including the degree of economic integration within the region, the degree of dependence of the economy on its trading partners, the relative economic strength of member countries, the similarity of trade structure between the members and the political relations between members. So, at the present stage of our country, we should adopt the rule revision type of WTO anti dumping agreements and through the analysis of rules and practice to strengthen the opinion. Finally, the author believes that China can adopt the type of abolish the law of anti-dumping+unify regional competition law in the future.
