Restrictions On Trade Remedies Apply

As a kind of trade protection form set for responsing to special trade crisis, traderemedies are widely applicable. But as a result of the system itself in the beginning ofdesign,there are many inherent defects.These defects lead countries’ unreasonable applicationof trade remedy measurea, Making its deviation from the set of the original intention,Andbecoming one of the factors that hindering the development of the liberalization oftrade.Facing the trend that all countries in the world more and more widely using traderemedy measures,combined with the activation function of the financial crisis,the importanceof limiting the abuse of trade remedy measures are increasingly prominent. This articleembarks from the trade remedy system itself,detailed interpretation of the institutional defectsand the reason of its being abused,then put forward the suitable path of limiting trade remedymeasures respectively from the perspective of bilateral and multilateral.In addition to the introduction, conclusion and appendix, the article mainly divides intofour parts, main content as follows:The first part mainly relates to the basic theory of trade remedy measures. Separatelymaking detailed introduction and comparison to properties, characteristics, specificimplementation way of antidumping measures, countervailing measures and safeguardmeasures.The second part deeply analyzed the three trade remedy measures’ defects,and the reasonof trade remedy measures to be abused. In order to highlight the necessity of restricting theapplication of the trade remedy measures.The third part discusses the bilateral path of restricting the application of the traderemedy measures. In this section, the author summarizes the rules that restrict trade remedymeasures in the existing regional trade agreements(RTA),and also make detailed inroductionand analysis to the particular way in these rules.At the same time demonstrating thelegitimacy of limiting trade remedies’ application.In order to provide reference for limitingtrade remedies’ application under bilateral trade system.The fourth part discusses the multilateral route of restricting the application of the traderemedy measures.In this section,the author based on the WTO multilateral trading system,putforward the way of improving trade remedy system’s own defects and transparency,to achieve the purpose of limiting the application of trade remedy measures under multilateral tradingsystem.No matter the developed countries or developing countries,it is a very important issue tolimit the unreasonable application of trade remedy measures,which aimes at maintainingbalance of trade and promotiing the liberalization of trade. All countries should strive tosearch for specific practices under bilateral and multilateral framework. So as to create a goodatmosphere for development of global trade liberalization.
