Upon the concept of juvenile justice, the construction of China’s Juvenile Police Systemis closely related to the appearance and the development of the Juvenile Police Institution.Due to an incremental process for juvenile from disobeying action of public security tocommitting crimes, early detection, treatment and education is of great significance. In thisregard, being in the front of dealing with all kinds of illegal behaviors, Public Security Organhas obvious advantages. What’s more, Public Security Organ controls and prevents juveniledelinquency effectively, which is agreed on by most of countries. Recently, owing to thelimited factors of the public security system and juvenile judicial philosophy, under the lackof unified guiding ideology, Public Security Organ deals with juvenile delinquency onlyaccording to the ideas how to solve crimes and whether the behavior is a illegal crime, and therule that appropriate education for juvenile is better than punishment is not carried thoroughly,and the regimen of social report, presence of legal agent, respective management and escortalmost turn to externalism, with the result that the legal rights of juvenile has not been fullyprotected, the consciousness of marginality has not been promptly corrected and the juvenilewould commit crimes again easily. Based upon above situations, this article lies in the specificcircumstance of China’s Public Security dealing with the cases of juvenile delinquency anddraws lessons from foreign juvenile police system. At the same time referencing to relevantliterature, combined with the writings of experts, the article puts forward proposals toimprove China’s Juvenile Police System.Except as the introduction and conclusion, the total is divided into four parts, totalingapproximately fifty-five thousand words, the specific contents are summarized as follows:The first part focuses on the basic concept of the cases of juvenile delinquency and thejuvenile police system, as well as the primary role of the police in the juvenile justice system.The juvenile police system is mainly focus on how to deal with the cases of juveniledelinquency which belong to its object category. The police in juvenile justice system mainlyplays three roles: the sponsor of judicial process, the adjudicator of many cases, the dispenserof many cases.The second part analyzes the status quo of China’s Juvenile Police System in accordancewith the specific situation of the investigation and the related data released by the justice department. First, this article introduces the present situation of China’s Juvenile PoliceSystem. Second, the article carries out specific analysis on the status quo and issue of theprocessing system of juvenile criminal cases, the processing system of juvenile status offensesand the processing system of other juvenile illegal cases.The third part outlines the representative of the Anglo-American law system—thejuvenile police system of the United States and Britain and the representative of thecontinental law system—the juvenile police system of Japan and Germany, and sums up thefeature of foreign juvenile police system from common and personal angle, and figures outreference for the construction of China’s Juvenile Police System.The four part mainly discusses the construction of China’s Juvenile Police System.Firstly, this article proposes the basic situation of the reformation of China’s Juvenile JusticeSystem, namely the trend of theory of the modern school, the trend of protection and welfare,integration, socialization and specialization. Secondly, this article points out the specialprinciples of China’s Juvenile Police System: education and protection principle,comprehensive survey principle, best interests principle, minimal damage principle,individualized treatment principle. Finally, the article proposes the improvement of theprocessing system of juvenile criminal cases, the construction of the processing system ofjuvenile status offenses, the construction of the processing system of other juvenile illegalcases and the construction of the auxiliary system of juvenile police system, with the aim offiguring out the specific implemental path to construct China’s Juvenile Police System.
