When Strengthen the law enforcement and judicial investigation,the legislation issues impact the judical process which cause the problems such as improper expansion of criminal subjects, bigger range sentencing.lighter criminal penalty, etc. If can’t solve the legislation issue of corruption, the country is not conducive to the further anti-corruption work and promoting China’s legal system.In the first part of the legislative history of the crime of corruption is discussed. It describes legislative provisions of corruption in ancient China, modern times and contemporary and mainly discusses the revision of criminal of corruption in1997criminal law.It puts forward to exclude "forging official documents and certificates to be national staff’from the criminal subject of corruption crime and put "official behavior of high consumption" into the behavior type of corruption crime.
