With the development of economy and urbanization, the housing estates are booming too. The rights and obligations in these estates are complicated by the increasing of the resident population. The ownership and use of the profit of the common parts of the housing estates is attracted people’s attention nowadays, and more and more conflicts are rising from this field. Although the property law of the PRC has regulations on condominiums, these regulations are too vague to apply. So, this article focuses on the problems of condominiums and common ownerships, analyzing the mature ideas of other countries in this field, providing some tentative suggestions.This article includes four parts. The first part is the summary introduction of the condominiums theory. The second part analyzes the profit of the common parts from the point of view of law. The third part introduces the successful experiences of developed countries and the fourth part is about the suggestions about the improvement of current system. The aim of this article is to suggest that the householders, as the co-owners of the building, have rights to manage the property and gain the profit from the common parts and decide the usage of the profit by owners’congress. In a word, householders’lawful rights should be protected.
