Research On The System Of Organizational Penalty

With the development of modern country and civil society, associations mushroom and bear widely social public affairs, and strongly promote the process of cooperative governance and political democratization. Association penalty system is a cutting-edge topic of domestic public law. Based on association autonomy theory, association penalty system protects social autonomy order at the level of public administration, collaborates and interacts with state administration so as to achieve good governance.This study starts from the origin of association penalty system, through discussion on associations and the concept, characteristics, historical origins and the legal nature of association penalty, leads to theoretical analysis on the root of authority and the legitimacy of association penalty, and thus discusses the basic principles and main form construction and reform path of relief system of association penalty on the basis of dialectical analysis on related historical practice of association penalty, in order to play a role as a hook and provide widow’s mite for improving and standardizing China’s association penalty system.The innovation of this paper lies in inspecting association penalty from an interdisciplinary perspective, discussing theoretical implication and the practical problems of the rule of law of association penalty through historical analysis and comparative analysis, which has certain novelty in research topic, framing methods and research methods. In addition, in establishment of system, with relevant theories of administrative law as main line, based on the theoretical roots and legal nature of association penalty, a number of system improvement suggestions are put forward, and legalization paths of association penalty under the context of China’s social transformation are discussed in depth, having a certain practical value.
