Research On Industry Association Punishment System

Along with the development of democracy and maturity of civil society, the third sector represented by industry association is rising, it shoulders the responsibility of communication between citizen and state. Based on the needs of management, most of industry associations stipulate the penalty measures, some penalty decisions even involve the third party beyond the industry association.The essence of industry association penalty power is still a kind of power, it has the possibility of abuse, so we have to set up regulation on it. But in order to maintain the autonomy of industry association, the state intervention must be kept within certain limits. How to define this degree needs our systematic combing of penalty power system in industry association. Only in this way, we can fine the key point.At present, there is no special "The Act of Industry Association" in China, and it brings great trouble for the practice circle to solve such problems. I argue that we should improve China’s industry association punishment system from legislative perspective. Firstly, we should formulate "The Act of Industry Association" of our country, making legitimacy, procedures and scope of industry association punishment power clear; secondly, establish industry association punishment for the record review system, strengthen the industry association annual inspection system; and finally, legitimacy of judicial review intervention and its scope should be clarified.
