Legal Analysis On Handling Students' Injury Accidents And Security Management In Colleges And Universities

The university is the holy land which transports national talents, provides intellectual support for the national economy, science and technology and culture construction. Since then, the security and stability of the university are very important for the harmony and stability of the society. In recent years, with the scale enlargement of the university, the safety accidents and disputes caused by the complex problems with the development of the opening education, school managements, and students’ own factors, ect. are increasingly growing. It is becoming a big problem that the students’ injury accidents happened in schools are continually disturbing the management of the university. During the treatment process of the university students’ injury accident, the analysis of accident, attribution of responsibility and the choice of relieieving means, etc. are being the central issue.The dissertation will put forward the reflections and suggestions for strengthening the safety management and pushing forward the security legislation by adopting legal knowledge to analysis those focus problems.Based on the collection of relevant scholasic works and through the investigation and analysis, this dissertation is divided into five chapters to explain the treatment of university students’ injury accident and the related issues about strengthening the safety management. In the first chapter, it analyses the characteristics of university students’ injury accident by means of the redefining the definition of the accident. The case study methodology is adopted to classify university students’ injury accident in terms of the causes of the accident. The second chapter based on the study of the legal relationship between schools and students in university students’ injury accident, it points out the view that the legal relation is about management, education and protection. The third chapter is the key part, the author is using relevant provision in "Tort Law of the People’s Republic of China" as the foundation to investigate the doctrine of liability fixation, the components of the liability, and rights relief in university students’ injury accident. It has identified the line of responsibility in university students’injury accident from a certain extent, which is the key in handling the university students’ injury accident. The fourth chapter discusses the advantages and disadvantages when the students and their parents use all kinds of relief way to safeguard their own legitimate rights from the perspective of judiciary, administrative and social, etc. and(puts forward the notes in the disposal of university students’ injury,accident. The fifth chapter discusses how to, according to law, strengthen the campus safety management, build a safe, harmonious campus environment, and puts forward reflections and suggestions to make up for the lack of legislation, to promote the legislation in university students’ injury accident. We should nip in the bud, because it is an important content to reduce the number of injuries of college students.The author has been engaged in maintaining the security and stability of the administrative management work of university for many years, knowing that prevention and treatment for students’ injury accident has important and profound influence on students, their familys, the schools and the society. Consequently, this paper as a master degree thesis, through analysis and study, aims to protecting students’ legitimate rights and interests, guaranteeing the education, teaching, scientific research activities of the university, and constructing harmonious and stable social atmosphere.
