Reflections On The Crime Of Drunk Driving

In modern society, science and technology is the first productivity. Along with the vigorous development of science and technology, the transport industry flourished. That played an important role in the community’s development and economic prosperity. However, luck and misfortune comes in turn. Hiding behind the bloom of transport industry, there comes a high incidence of traffic accidents, especially serious ones, which is a threat to the social public security. Influenced by the diet and sociality culture of our country, it is common phenomenon that drinking in every feast and drunk driving can be seen everywhere. Because of the raising of the incidence of traffic accidents, the whole society paid attention to restraint of traffic accident caused by drunk driving. Finally, The people’s Republic of China Criminal Law Amendment(8th) makes drunk driving a crime. That means the criminal law system for drunk driving has entered a new era.The behavior of drunk driving has been made a crime for nearly one year. the author tries to draw on advanced foreign legislative practice, the actual situation in our country on the criminal law system for drunk driving behavior of the corresponding solutions proposed to improve the relevant criminal legal system.
