A Study On Some Difficult Problems In Crime Of Causing Traffic Casualties

At present, the situation of traffic accidents in our country is rather grim. With the rapid development of economy, cars are becoming more and more popular in our society; however, the ratio of traffic accidents are growing increasingly. Therefore, a further research on those traffic offenders is of great importance. Speaking of this, there are a lot of researches on traffic accident crimes done by Chinese and foreign scholars. Moreover, the domestic scholars even regard the problem of how to understand, apply and improve the traffic accident crimes stipulated by the Criminal Law as a major task of the theory of criminal law and judicatory practice. Given all of that, based on the reference to a lot of works and papers, the writer analyzes these research results carefully from the concept of traffic accident crimes and the constitution of a crime. Besides, the writer tentatively discusses on the common difficult problems of the body of the traffic accident crimes, the runs-away after traffic accidents, the killing caused by running away and the accomplice of traffic accidents in the judicatory practice, and puts forward my own opinions, hoping to help improve the legislation and application of China’s traffic accident crime.
