A Study On The System Of Elimination Of Minors' Criminals In China

The criminal record has the critical impact on the offender’s life. The minors’criminal has the profound social reason, is extenuating. The opportunity of re-socialization should be given to these minors. The elimination system for minors’ criminal record will help these minors accept the social norm which is in line with the interests of the majority, and return to the society. On the other hand, the existence of criminal record will have many negative impacts and juristic influences on those minors due to their powerful suitability and less subjective evil thoughts. The elimination system for minors’criminal reflects the guidelines of education, reform, remedy for the minors and the policy of temper justice with mercy.This paper contains three parts. The first part expounds the concept and juristic consequence of eliminating the minors’criminal record. On this basis, the meaning and type of elimination system for minors’ criminal record has been analyzed. The second part introduces the theoretical basis and practical significance of the elimination system for minors’criminal record. The necessity, rationality and feasibility have been confirmed by comparing the research from the domestic andthe foreign with the comparative law. The last part, discusses the establishment of elimination system for minors’criminal record in China from applicable condition, operational process to support mechanism. It may provide some feasible suggestions to the development of the elimination system for minors’criminal record in China.
