A Study On The System Of Public Participation In Urban And Rural Planning In Britain And

With the gradually perfecting of our jurisprudence and construction of civil society in the recent years, more and more citizens realize the importance of democracy. There has also been major progress in developing the rule of law and local democracy and encouraging public engagement, for example, the establishment of a system of public hearings on great matters, open information system, a system of public participation in legislation and so on. It is expanding the scope of public engagement that arising the civil enthusiasm, building the strong foundation in society and promoting the development of socialist democracy and rules of law. But there still have much more fields can be developed in public engagement which one of them is urban planning.I have selected the system of public engagement in the field urban planning and studied on it, because public participation in urban planning is still a new subject which has been required and beneficially explored in practice; however, we have a long way to go to build an effective participation system which means we still have to pay more attention on it. In Britain and the United States, public engagement system has become the essential legal part and also formed a set of completed legal system after the development for half of a century. They have developed jurisprudence from top to bottom, ripe research for methods and constant innovation which bring significant reference on the exploration and development of public engagement system in the field of urban planning in our country.This essay introduces the public engagement system in the process of urban planning which aims to reflect how it work well in the field of urban planning in the UK and United States. It can play some roles for the development and complement of public engagement system in some areas in our country. First, I discuss the content of public engagement system and put forward the meaning of why it works well in the field of urban planning after the Introduction of background in these two countries. And I review a few important stages of development which they have experienced in public engagement in urban planning; Second, I make legal analysis on public engagement in urban planning and make a systematic introduction on why the public engagement system can be established and which modes it has in America and Britain. They provide a basis for specific research on public engagement system in the below; Third, I discuss the legal system, institution, process and safeguard mechanism of public engagement in urban planning in America and Britain respectively;Finally, I introduce some problems existing in the public engagement in urban planning in China currently, analysize the gap between China and America and Britain. I also point out what we can learn from America and Britain institution, which improve the effectiveness of Chinese related legal system.
