Online banking as a new financial services model, along with the increasing development of Internet technology, has become an integral part of e-commerce. Online banking has brought a lot of convenience in everyone’s life,and many unavoidable problems to protect the interests of consumers. The virtual sex of online banking has resulted in the characteristics of high-risk, existing laws have not fully adapted to the development of online banking and the need to protect the interests of consumers.That is why the rights of online banking attract widespread attention.Object of this study is the online banking consumers. Learning from a typical case, we can know how to protect the rights of online banking consumers and the main problems,and find a suitable road to protect the rights in legislative and regulatory areas.This paper is divided into four parts:The first chapter is comprehensive introduction, system is introduced in full from the selected topic background and so on.The second chapter is divided into two parts:the first part introduces the stolen case of Mr. Tan’s funds in online bank, which leads to explore the direction; the second part is to define a few basic concepts in this article,defines online banking and online banking consumers.The third chapter is divided into two parts:The first part is from the legal problems faced by consumers in online banking, issues involved in five areas:property rights,fair trade,right to know,privacy and reasonable claims.The second part analyzes the causes of these five issues arising,analysis from online banking their own characteristics and external factors.The fourth chapter is from the macro and micro aspects to give legal advice:selecting suitable model for Chinese legislation and give legal advice to solve the problem in the article.
