Research On Litigation Fraud

Litigation fraud not only infringe on citizens, organizations, corporate legal private property rights, consume a large amount of manpower and material resources for the whole or part of false litigation, but also a violation of China’s judicial order,damage the judicial authority.The value of the system of litigation to resolve disputes was damaged by litigation fraud, but there is no corresponding regulation in China’s current law with efficiency, we should take effective measures.This paper analyzes the problem of litigation fraud, the main content is divided into five parts:The first part is the introduction, describes the research background, research significance and the research status, summarizes the research methods and ideas.The second part is the overview of fraud litigation, including the concept, the characteristics of litigation fraud, modus and the constitutive elements.The third part is the comparison research on the litigation fraud, through a comparative study of the legislation of our country and foreign legislation, trying to learn a foreign experience to improve the regulations of our current litigation fraud.The fourth part is the analysis of causes and harm of litigation fraud regulation theory, to explore the deep-seated of litigation fraud.The fifth part is the suggestions of the fraud in lawsuit, divided into the idea of the creation of the improvement of the existing system and the new system.
