Research On The Factors Affecting Judicial Authority

With the deepening of judicial reform,judicial authority has been gradually strengthened.However,incidents of disrespect for the law and violent resistance to the law occur from time to time.Many facts show that in contemporary China,the judicial activities of the state still lack wide recognition from the society and the judicial authority has not yet been fully established.Judicial authority itself is complicated.First of all,it makes a theoretical analysis of its meaning.Judicial authority is a kind of social prestige that takes procedural justice as the premise,maintains the judgment results of judicial organs as the core,and uses the state's coercive force to ensure that the effective judgment of judicial organs can be obeyed by the parties and gain public trust,and finally achieves the purpose of maintaining legal authority.On this basis,combined with theory and actual situation,the factors that affect judicial authority are summarized into five aspects: subject,procedure,judgment result,execution effect and social foundation of rule of law.Further analysis is made.In the current judicial activities,there are problems such as the average professional accomplishment of judicial subjects is not high,procedural justice is not paid attention to,judicial process is not open and transparent enough,judgment result is affected by various unfavorable factors,the execution of judgment is difficult,and social awareness of respecting the law is weak.Therefore,it is proposed to improve the professional quality of judicial subjects,optimize judicial procedures in many aspects,prevent "excessive supervision" from interfering with the judgment results,guarantee the judicial execution,and build a solid mass foundation in a society ruled by law,so as to further enhance China's judicial authority.
