On The Perfection Of Civil Summary Procedure In China

Summary of civil trial procedures as an important part of its role directlyaffects the efficiency of the trial of civil cases. However, the law and trial practiceproblems, the civil summary procedure still need to improve. In today’s robust handlingstressful situations, how to optimize the allocation of judicial resources, so that the judgecan take into account the fairness and efficiency to quickly resolve the contradictions ofthe people is the purpose of this paper. This paper analyzes the study of China’s relevantlaws and regulations on civil summary procedure, and lists the current civil summaryshowing a series of problems in practice, research summary of the establishment of theCivil value and function, and after than other countries or regions the relevant provisionsof the Civil Summary Procedure, suggestions for improvement of our civil summaryprocedure on this basis, the perfect proposal includes detailed provisions related to civilsummary procedure, the establishment of a special steering mechanism, the use of modernscience and technology to strengthen internal supervision of the court etc., in order toperfect the ultimate goal is to rely on limited judicial resources to resolve social conflictsmaximum.
