A Comparison Research Of Copyright Trade In China And USA

The close combination of the international trade and the intellectual property rights has become a notable trend in development of the world economy and international trade. The foreign copyright trade is the concrete manifestation of this trend in the publication field. Foreign copyright trade in our country started comparatively late, and the overall level is backward, while the US, with the most active copyright trade in the world, has established the most perfect modern copyright system. Therefore, it is of much necessity to analyze comparatively the foreign copyright trade of the two countries, through which we could find the weaknesses of China in the copyright trade, so as to learn from the US and absorb its successful experience to promote the development of copyright trade of China.Now, the copyright trade does not cause an enough value in China where the domestic publishing houses, with the traditional concept of books publication, rarely make much profit from the foreign copyright trade. This article attempts to make a comparative analysis on the following aspects: the situation of development of the copyright in the two countries at present; the legal protection of the foreign copyright trade in the two countries; the management of the copyright trade and other related issues. We aim to find an integral development strategy of foreign copyright trade with the Chinese features, hoping that it will be helpful to the development of the foreign copyright trade of China. This article consists of four parts: firstly, a precise definition of both the copyright trade in China and that in the US will be given; then a comprehensive analysis on the trade' s legislation and law enforcement of the copyright trade both in China and US is to made; and then , an thorough and systematic discussion on both the management pattern and the management method of the copyright trade in the two countries will be presented; finally, some suggestions of solutions to the existed problems and weaknesses in the China's copyright trade is abut to be offered. We hope that this article can play the role of offering a few ordinary introductory remarks so that others may offer their valuable ideas or providing some reference to advance the China's development in the copyright trade.
