Research On Intellectual Property Issues Of Digital Library

The emergence of Internet, as the representative of the computer and the technology of network communication, makes the digital library become the theme of the library in the 21st century. During the digital construction of the library, the intellectual property issues of the library become one of the focuses that at present the international theory circle and the administrative departments pay close attention to. As the super large-scale resources bank under construction, the digital library faces the intellectual property problem of magnanimity literature resource to be digitized, virtual resource establishment and information service, along with the intellectual property problem of the database establishment. Though countries all over the world has adopted countermeasures to solve that problems described above, a lot of questions to be solves need to reach common understanding on the basis of discussing deeply.The purpose of the dissertation is to clarify the concept, the characteristics, the legal status of the digital library and the intellectual property problems the digital library faces, it is discussed the corresponding measures to solve these intellectual property problems in order to realize real resource-sharing including the measures of legal, management and improve digital library management capability of the copyright. Chapter I discussed the definition of a digital library, features, the main character and its development status .We know these elements is the digital library of intellectual property rights to solve the problem on the premise .Chapter II of the digital library information resources building facing the issue of intellectual property rights .In my view , digital library information resources building facing the issue of intellectual property rights, including the main entities of the building stock of resources, the virtual construction of two collections of resources faced by the issue of intellectual property rights .Chapter III of the digital library database building facing the issue of intellectual property rights, mainly involved databases of copyright protection, the protection of special rights and the self-built digital library database and the purchase of the database , and other database-building projects involved in the issue of intellectual property rights .The fourth chapter of the digital library services intellectual property issues, including the digital library for personalized service,intelligence analysis and decision support services and electronic services under the model involved in the issue of intellectual property rights. I focused on copyright law on the rational use of the system, statutory licensing system to solve the digital library copyright issues and the need for adaptation, at the same time, also proposed to set up libraries in the digital copyright authorization settlement with the copyright protection technology center, digital library for a comprehensive solution to the problem of copyright licensing, and copyright works to be comprehensive technical protection, with a view to achieve the smooth development of the digital library at the same time, but also safeguard the legitimate rights and interests of copyright owners.
