A Research On The Intellectual Property Rights And Their Protection Of The Digital Library Databases

In Modern society, it is very important to attain accurate information in time for personal study and life, business operation and even the development of country. In the era of information explosion, information is unlimited and grows at an alarming rate. With the development of society, information increases. In the face of the vast, messy, disordered information, it is difficult to find information we need. We can't imagine there is no search engine. Human has been actively exploring the tools and instruments of organizing and managing information. With the development of computer technology, database technology came into being and the database functions like search engine. The emergence of database technology has greatly enhanced the efficiency of managing information, and is increasingly becoming the important information managing tools in modern society as well as important social component of information resources.This dissertation is divided into 5 chapters.1. Defines the digital library and database, indicates that the main object of this article is the intellectual property issues of building databases in the process of the transformation from the traditional libraries to digital libraries, makes a summary of the latest progress of the databases at home and abroad.2. Discusses the necessity of protecting the databases, legislative status of databases, including United States, EU and our country,and takes the example of "Copyright Law" and "the Right of Information Network Dissemination Protection Ordinance" to describe the status of our country.3. Discusses the intellectual property rights issues in the progress of building databases of the digital libraries. Divides the digital library databases into self-built databases, cooperative development databases, purchasing databases, and analyzes their intellectual property during the construction process.4. Analyzes the protection measures of databases, including the protection of copyright law, the protection of anti-unfair competition law, the protection of contract law, the protection of special rights,and the protection of technology. 5. Gives a summary of the importance and significance of intellectual property protection of the digital library databases for the information industry and the national economic development.
