The Study Of Anti-dumping's Game Between China And America

With the development of China's trade, trade dispute and trade friction are coming out constantly and more and more fiercely. Since we entered into 21 century, the unfavorable economic situations of the United States and the Europe Union and Japan etc. make the trade protectionism boom again. The trade friction which involves anti-dumping; anti-subsidy and safeguards as the most measures has evolved into a no smoke of gunpowder war. However anti-dumping as one of the most important measures of protection is used widely even abusively.Sincel995, China has been becoming the biggest casualty of the usage of anti-dumping continually in ten years. The cases we faced in these years are revealed some features: accused frequently; punished severely and the money related to the cases is abundant. And all of these cause high attentions from our government, companies, the law circle and the academe.This paper tries to use game theory to analyze the anti-dumping problems we encountered. In order to make deeper research on it, I focus this question in two countries -China and the United States. In the first chapter, there are an introduction of the current situation of anti-dumping between China and the United States and the meaning of this essay's research. In the second chapter, I mainly talk about the theoretical basis of game theory. In the third chapter, standing on three different points-lawmaking general situation, material law of anti-dumping and procedural law ofanti-dumping, it compares and analyzes the jurisprudence between China and America. In the forth chapter, applying the method of game theory, the paper establishes the static and dynamic anti-dumping game models between China and America. On the other side, I make tests of hypothesis and draw three conclusions. A t last, basis on Dixit-Olson's anti-dumping game model, I make test of hypothesis and make two conclusions. In the fifth chapter, I use pictures and forms to present the data which show the position, current situation and questions of anti-dumping between the two intuitionisticly. In the last chapter, combining with the comparing analysis in the chapter 3,I point out where our anti-dumping laws need to perfect further. Afterwards gathering the conclusions and suggestions getting in the chapter 4 and 5,I profound many constructive suggestions to our country including a trailblazing new countermeasure to evite anti-dumping. Moreover I explain its applicable condition as well as give a practical example to proof.Combing theory with practice; qualitative research and quantitative research; the modern game theory and the traditional Chinese game thought, this paper applies game theory to interpret anti-dumping actions between two countries and this method can also be applied to anther two.
