The Research Of The Governance Structure Of China's Security Investment Funds

At present, there're some important issues of the governance structure of the security investment funds in china. In the long run, if these problems couldn't be solved properly, it will be "bottleneck" which will restrict funds industry's development of our country. These problems include: Holder's interests of the funds represent omission, while the funds manager has grasped too much power, and has not be supervised effectively; the existing abstraction way of the funds administration expense does not form effective encouragement to funds managers; the funds organizational form should be innovated and perfected because of its limitation. Against above three questions, the text is using policy analysis and comparative analysis methods mainly and putting forward some ideas and advices to improve our country's funds governance structure through analyzing the actuality and figuring out the existing problems and basing on other countries' funds governance structure for reference.This full article is divided into four chapters. In chapter one, some definitions about funds governance structure are preliminarily depicted. The main content, theory origin, particularity and complexity of the funds governance structure are pointed out.In chapter two, four funds governance mode are introduced in detail. There are the mode of U.S.A. mutual fund , the mode of Romano-Germanic civil law tradition, the mode of Anglo-American common tradition and the mode of Japan. And some successful experiences are. summarized which could be used for reference in improving the governance structure of China's security investment funds.In chapter three, the forming and development of the governance structure of the security investment funds of our country is shown firstly, then the actuality and existent questions are analyzed through three respects: the inside governance, the outside governance and the third party governance.In chapter four, some measures are put out to improve our country's funds governance structure, including establishing a trustee committee, reforming the abstraction way of the funds administration expense, and introducing the corporate-type funds for improving the legal organizational form of security investment funds.
