Investigation On The Compensation Of Coal Resources Exploitation Of Xinjiang

Abundant coal resources of Xinjiang provide favorable condition for developingcoal power and coke chemical engineering, give important role play to superiorresources strategy transformation of Xinjiang and activate significant chemicalindustry base of the nation. However, the contradictions between resourcedevelopment and ecological protection, interest of resident of the producing area areextruding day by day during the course of development of coal resource industry ofXinjiang. In order to promote a coordinate development between the exploitation ofcoal resource industry, economic and society, it’s necessary to set up a compensationmechanism which is fit for indigenous resource exploitation of Xinjiang, andcomplete the relevant policy for compensation of the place of origin, to seek feasibleway to solve the problem between coal power development and benefit of theinhabitant of place of production. Based on summarization about correlation theory ofcompensation for place of production and experience of compensation for place oforigin at home and abroad, this article analyze the current situation and problem ofcompensation for place of origin during the coal resource development of Xinjiang,structure basic framework of compensation mechanism for coal resource exploitationof Xinjiang, finish the empirical analysis to the case of the exploitation Subject of“The Mine NO.1Of Fukang Gas coal Limited Liability Company Of Xinjiang CokingCoal Group(Herein after referred to as The Mine NO.1Of Xinjiang Coking CoalGroup Of Ba Gang in Fu Kang), put forward the operational supporting measure forcompensation mechanism of coal resource development of Xinjiang.The main content and conclusion of this article:(1)Analyze the current situationof the implementation of compensation mechanism of coal resource development ofXinjiang, unfold discuss from several aspect hereinafter: general situation of coalresource exploitation and utilization of Xinjiang, the influence of coal resourceexploitation of Xinjiang to the ecological environment of producing area, the effect ofcoal resource development of Xinjiang to the production and living of the local people,the policy analysis of current compensation of Xinjiang Province.(2)The constructionprinciples of compensation mechanism of coal resource development of Xinjiangbring into correspondence with other regions as below: the polluter is supposed to govern; the beneficiary is responsible for compensation; the new accounts and oldaccounts are divided and ruled, etc.(3)The critical elements of compensation systemof place of origin are as below: the principle parts of compensation implement, theobject of compensation, the receiving parts of compensation, the ways ofcompensation, and the standard of compensation. Thereinto, the principle parts ofcompensation implement should be the enterprises of coal resource development andthe departments concerned of the place of production. The object is personalization ofthe compensation target, should be the directional subject matter of the compensationcapital. Following parts should be included as the receiving parts of compensation(which is also called indemnification subject): the state or government who possessesthe proprietorship of ore resources, the parts who suffer the loss because of oreresource exploitation, the organizations and personages who make a contribution tothe restoration and control of ecological environment, compensation for local peopleand employment from a later period of local residents in the production area. Thecompensation pathway should be the capital source or channel of compensation.Following compensation ways should be included: the new accounts and old accountsshould be divided and ruled; the coal resource company is responsible for eithercontribution of capital or improvement and rectification; the local government isresponsible for either contribution of capital or improvement and rectification; thecompany and government are responsible for contribution of capital, the governmentshould take charge of improvement and rectification; the company negotiate with thelocal people and take out measures to finish the compensation.
