On The Construction Of Natural Resource Assets Property Right Legal System In China

Natural resources are the basis for human survival, its property rights system play a crucial role in the development and utilization of natural resources and protection. They have already been proved by practice and history of mankind. China’s industrialization process accelerated in great demand on natural resources, but the destruction of natural resources and waste have been more and more serious, and caused some environmental pollution. Natural resource assets property right is to enable the owner of natural resources with a clear, by his use of these resources to get benefits; he can also bear the responsibility to protect resources. Otherwise there will be "tragedy of the commons" in economic; resources are being overused because they do not have sovereignty.Strengthening natural resource property management, clearing the natural resource assets property right, it has become the sustainable development of natural resources on the basis of work. Eighth session of the Third Plenary Session of Natural Resources proposes to establish a sound system of natural resource assets property right. In accordance with this requirement, we have a urgent need to strengthen natural resource management and build legal systems of natural resource assets property rights. First, we must establish the legal regime of natural resource assets property rights, clear its concept and content, and to determine its contents. The second is to define the main body of natural resource assets property rights through a series of legal and economic policies, to determine how to manage natural assets property rights. The third is to establish a unified and open market, relying on the market rules, the establishment of the market mechanism, to format the natural resource assets property rights trading system. The fourth is to use macroeconomic regulation and control mechanism, through a variety of "green" taxation, credit, and other policies, and to make the rights transfer. The fifth is to strengthen the protection and supervision mechanism of natural resources assets property rights, and by all means to protect the property rights of natural resources assets.
