Study On The Protection Of Ecological Migrants Rights And Interests In Water Source Area Of South To North Water Diversion Project’s Middle Line

Ecological migration is typically used to protect the ecological environment. Largequantities of residents are transferred to new areas from the environmentally fragileareas or environmentally sensitive areas. This sort of well-organized movement isaiming at providing a better production and living condition with residents. With thegrowing concern on the ecological environment and building conservancy projects bygovernment, China has organized out the ecological migration activities in the regionsince the latest century. However, the ecological migrants still have some problems forvarious factors in practice. Under the background of a harmonious society, building"people-oriented" is an urgent problem in our country. In the process of balancingecological migration, how to coordinate the relationship between the public interest andindividual interest, how to give more protection to those who need it, and how tosafeguard the legitimate rights of the immigrant groups, is a burning issue.This article used the risk society theory and institutional change theory and alsoused the field research method, system analysis, semantic analysis, document analysisand value analysis. The project topic is focused on the ecological migrant rights andinterests in water source area of south to north water diversion middle line, and thendefined the related concepts and make a further study on the historical changes andsurvival status. We know three major issues, Survival and development imbalances,defect compensation and public participation hindered. On the one hand, from thesystem and defect analysis on ecological migrant laws and policies in South-to-Northwater diversion of middle line, it will find out the reason for the institutional level of interest in damage; On the other hand, from the legal concepts through Analysis of thelegal interests and legal beliefs, we can sum up basis points and the crux of the problemof the ecological migrants rights and interests in water source area of south to northwater diversion middle line. At last, From both internal and external perspectives, theproposed legal reform reshaped the legal concepts and improved legal system, which isthe effective measure and inevitable choice to guarantee the right of ecologicalmigrants.
