Legal Countermeasures To Deal With The Heavy Metal Pollution In The Basic Farmland In China

In recent years，many heavy metal poisoning cases have happened on rice，vegetables and other kind of primary products, which highlights the serious level ofheavy metal pollution in farmland. In view of these problems, a number of scholarswho from soil science, environmental science, ecology science and other naturalscience have made much effort and abundant achievements in the last several years.However, the heavy metal pollution in the basic farmland is a secondaryenvironmental problem which is caused by human activities, reflects the inconsistentrelationship between people and the environment and require legal measures.At present,China starts to attach great importance to the prevention andtreatment of heavy metal pollution in the basic farmland, and related work hasalready started. All these work is at the expense of serious heavy metal pollution inmany places farmland. In this context, the author tries to explore from the followingquestions: How serious about the heavy metal pollution in farmland? What’s the wayof heavy metal contaminants entering the farm? What would be the harm? Whywould yield no prior discovery? What’s the real problem currently facing work? Whatadvice would improve? Thus,according to the thinking road which asking questionfirst, then analyzing problems and solutions to those problems last, the author discusseach part one by one.In addition to introduction and conclusion, the article is divided into three parts.The first part: The status quo of the heavy metal pollution in the basic farmlandin China. For a comprehensive understanding of the status quo of the heavy pollutionin the basic farmland,the author would describe from three aspects,which thehazardous conditions, pollution and pathways of the heavy metal pollution in fivemain areas of agricultural farmland are contained.The second part: The major legal issues which respond to heavy metal pollutionin the basic farmland in China. The author believes that the missing and defectivebasic system is the main question in the measures to deal with heavy metal pollutionin the basic farmland in China.To deal with heavy metal pollution in the basicfarmland, we should work on the basis of the environmental standards, and with thecore of soil monitoring and early warning, and by the means of the follow-upmanagement measures. So, the author analyze each of basic system, the environmental standards, the soil environmental quality monitoring system, theclassification system of the polluted farmland,the ban producing division andadjustment system for heavy metal pollution，the soil remediation system for heavymetal pollution all contained.The third part: The suggestions on the legal countermeasures to deal with heavymetal pollution in the basic farmland in China.This part offer the suggestions mainlyon the legal system, is the focus of the article. For the second part of the analysis, thissection also put forward specific proposals one by one in the same order.
