Chongqing established a rural land exchange and initiated land voucher deal in September 4th,2008. Land voucher deal has caused widespread concern. Chongqing government has a great ambition that they not only hope to accelerate the speed of urbanization but also want to popularize this invention to the whole country. This article will first introduce the background and the nature of land voucher deal. And then, from the real estate companies' view, this article will discuss the effect to these companies caused by the land voucher deal. In conclusion, this paper believe that land voucher deal, as an important invention under the land administration system, will have a deep influence to land legal system reform in China.This article is composed of three parts:forward, text and conclusion. The text has five chapters.Chapterâ… explains the background of the land voucher deal. Firstly, because of land issues in Chinese land regulation law, the gap between these regulations and the illegal facts has grown bigger and bigger which hurts the law itself. Secondly, there exist a possibility between the urban construction land in short supply and the rural land inefficient use. Thirdly, the reform of urban and rural areas in Chongqing and the scholars'proposal makes the transaction become true.Chapterâ…¡describes whole status of the land voucher deal. Land voucher deal is not a totally new thing which has its prototype a long time ago. This chapter will describe these 2 types of prototype and then describe the legislation and the development of the land voucher deal. This chapter will also update some statistics of the deal from the investigation and the research.Chapterâ…¢firstly adopts economic analysis of the land voucher deal. Pareto optimal theory, the range rent theory and real estate asset securitization theory is all used to interpret the deal as the economic basis. The land voucher deal achieves a Pareto optimal improvement through the release of the urban location rent by the securitization. After that, this chapter also analyzes the land vouch deal in legal theory. It proves that the land voucher system has its legitimacy according to the above reasons.Chapter IV illustrates the value, the problem and the suggestions for improvement of the land voucher deal institution. Firstly, the land voucher deal institution is not perfect which really has some faults. This chapter gives some suggestions on how to develop this institution for the performance of the land regulation reform in China.In conclusion, this article gives the final suggestion:We should popularize the land voucher deal institution to the whole nation in the future to perform land regulation reform.
