The article research from the view of empirical, County, selected Anji as a case in-depth analysis, pointed out that although the government acted as a major role in the management and protection of tourism, but market forces also plays an important role in the process of the tourism development and operation, the ownership of tourism resources is an important prerequisite for the Government in the process of change in tourism management functions, and clearly positioned itself.The author believes that the development and protection of tourism requires not only sound legal regulations and strong oversight accountability system, but also need to clearly define property rights, under the premise of the unity of the rights, responsibilities and benefits to achieve the free flow of the ownership in the market system, give full play of the property rights to the role of incentives and configuration. The most effective form of tourism development and protection is a dynamic equilibrium model, in which the governments'functions changing based on the characteristics of tourism resources and the maturity of the tourism market to achieve the complement and promote each other between the government and the market.
