The traditional environmental tort compensation has been unable to withstand the heavy because the environmental pollution accident has some special properties, such as wide hinted, large of victims, difficult restoration, huge compensation, and so on.At present, most developed countries have established a set of scientific and reasonable social security systems for the compensation of pollution damage to the environment, environmental pollution liability insurance is one kind of important systems. As one of the important methods of risk socialization, policy-holder need pay a certain amount of insurance premium, environmental liability risk can shift to the insurer in the environment responsibility and be eventually shared by risk maker, so the government, enterprises and the victim could form multi-win situation. Because of lots of advantage, our country also promotes the system vigorously.The paper mainly uses comparative analysis and empirical research method to summarize the basic theory of the environment pollution liability insurance, compare foreign related system and analyze some specific problems in pilot areas of our country, then discuss the feasibility to establish China's environmental pollution liability insurance system so as to provide some operational ideas and suggestions for building and perfecting the system in China.First, the paper demonstrates that the environmental pollution liability insurance system should be one of the most important means of environmental relief socialization, explains the related theory of environmental pollution liability insurance systematically, and mainly focuses on analyzing the particularity of the environment infringement and the disadvantages of traditional environmental compensation system. Secondly, the paper expounds the feasibility and the necessity to establish this system in China. Using empirical research method, the paper investigates the present situation and the current environmental protection mode, emphatically analyzes the current situation in some pilot areas and the cause of the slow development, and points out that China must establish this system further. Finally, the paper proposes the concrete system that provides relevant suggestions and countermeasures from the viewpoint of insurance mode, insurance coverage, insurance institutions, premium rate, damaging compensation, evaluation standard and the establishment of related security policy.
