Several Legal Issues On The Source Of Rural Social Security Funds

The lack of funds is the biggest problem to establish rural social security system. From the perspective of the sources of funds, it is not enough for the three major focus of the rural social security system such as rural old-age social security, new rural medical insurance and rural subsistence allowances. In spite of the countries'investment in the rural social security has been increasing, the lack of funds is the greatest obstacle in the current rural social security's construction.Meanwhile, it slows down the development in building up the rural social security system. There are some main reasons for it, as follows: firstly the misunderstanding on the rural social security; secondly the insufficient focus on principal responsibility; finally, lack of law in the rural social security funding sources: insufficient legislation at the national level, the lack of local regulations, the legal system running poorly.The government provides funding support for the rural social security, it is the embodiment of the functions of public finance. The government-led funding source and legislative, the following focus should be considered: supporting some regulations on investing rural security system in the law such as the Budget Law; make sure the government can take the funds from the farmers'land income in Land Management law ; turned Agricultural funds to the farmers'insurance funds in the Law of Farmer's Rights Protection; timely formulate the Law of Social Security Tax on collecting social security tax; legislate to make the standard of State-owned shares hold for enriching the social security funds account; timely make the Law of Lottery on releasing social welfare lottery.However, the collective and the peasant bearing one part of the funds is the request of the authority coincides with responsibility. There are several issues the Source of collective founds needs to be emphasize of: to regulate taking the founds form collective enterprise profit in the law of rural social security system; to revise the relevant regulation of the real rights law to take rural social security system funds form land and forest land; to modify labor law to regulate that the employers pay social security funds. Meanwile, there are several issues the sources of personal founds needs to be emphasize of: to regulate full amount compensation for the peasant by revise the rural land contract law; to enact more law and regulations about favorating peasent policy; to enact the Census Law to reform census register system. Finally, we can get five fundamental conclusions. The first, the country,collective and personal should provide the funds together in the source of rural social security system funds. The second, the building of the rural social security system will be very difficilt without financial support and Government-led. The third, our country have the ability to support the basic financial demands. The fourth, the rural social security system should develop gradually. The fifth, the stable source of rural social security system funds must depend on law.
