A Practical Study On WTO Dispute Settlement

The dispute settlement system of WTO is not only an improvement of the GATT dispute settlement system, but also an improvement of the dispute settlement system of international trade. It's the most perfect and effective dispute settlement system with widest adjustment, biggest maneuverability and compulsion, and all kinds of means to settle dispute. It increases the efficiency and foreseeability of dispute settlement. Its practice strengthens and ensures the rights and obligations of the WTO members, and gives maintenance to the running of multilateral trading system, and promotes the development and improvement multilateral trading rules. So it is significant to make a study on WTO dispute settlement, especially for China after the access to WTO.For this purpose, on the basis of all the preceding research work, the author uses the method which combines the theoretic analysis with the cases analysis, to analyze and research trade dispute settlement system and practice for achieving meaningful revelations in order to help deal with trade dispute with other members of WTO. First of all, the paper emphasizes the system of law on settling disputes. Through analyzing, this system's advancement from the period of GATT to the period of WTO, applying law and economics analysis to measure economic cost and economic benefit of WTO dispute settlement system in order to obtain some suggests for pursuing most economical way to deal with our trade disputes.
