Study On Professional Liability Insurance For Construction Supervision

Construction supervision system in our country has made great strides in development, but with the market environment changes, has encountered some problems, in which, the most serious one is professional liability is not matched professional risk, the legal responsibility of supervision company and engineers need to be strengthened, and social regulatory system also need to be improved-further. Practices at home and abroad show that building the system of professional liability insurance for construction supervision is an important measure to improve the situation.But construction supervision in our country has a special background and content, professional liability insurance system has just started in this field, no mature experience. Therefore, to establish the construction supervision professional liability system with China's demand is an important and urgent task. This paper studies on some key issues of this system, principally as follows:(1) Abroad and domestic consulting engineers professional liability insurance: analysis of the major foreign consulting engineers professional liability insurance status, including the United States, Australia, UK and FIDIC organizations, and professional liability insurance system for design in the principal cities. Then inspiration for supervision is analyzed.(2) Construction supervision professional liability: Firstly, the theoretical basis of construction supervision professional liability, and distinction between the concept of construction supervision liability and its professional liability are analyzed. Secondly, based on analysis of relevant laws,, regulations and contracts, construction supervision professional liability defined by contract, liability and exclusion defined by laws are studied. Finally, basic liability principles, the criteria for determining fault and the fault of proven principles are researched.(3) Construction supervision professional liability insurance contract and practice: At first, several key issues on professional liability insurance contract are analyzed, including insurance target, ways of insurance, limit compensation and rates, and advice is given in light of China's a actual situation. Secondly, study on how to implement professional liability in China.(4) How to improve construction supervision professional liability insurance system: from government, industry associations and insurance intermediary, proposals to improve our professional liability insurance are given.
