Causes And Strategies Of Curbing: Commercial Briberies In The Field Of Construction

With the continuous-expanding scale of the engineering construction in China, the field of engineering construction has become a high-incidence area of commercial briberies. According to the current serious situation, combined with the trade characteristic of engineering construction, this paper uses the"soft regime"theory of the Swedish economist Gunnar Myrdal and the method of cost-benefit analysis to do some systemic research into the main bodies, behaviors, causes and precautionary principles of the commercial briberies in this field.In this paper, the writer thinks the field of engineering construction primarily involves four types of main bodies: project proprietors such as the government, juridical associations, state-owned enterprises, joint stock companies, exploitation projects, personal organizations or persons; contractors responsible for engineering survey, design, or construction; intermediaries dealing with project management, process monitoring, construction cost consultation, bidding invitation, quality detection, or evaluation of real estate; other governmental departments in charge of construction examination and approval or supervision. The paper narrates that the commercial briberies in the field of engineering construction mainly take place at the links of market access, planning programming, tax relief, bidding invitation, purchase of building materials, project budget, fund appropriation, design alteration, etc. Also, the paper discusses the concrete performance of commercial briberies with large quantities of examples. Based on this, the paper analyzes the causes of the commercial briberies in the field of engineering construction considering such aspects as lax supervision in construction markets, bidding invitation, engineering quality and administrative examination and approval, light punishment in law and high profits in the field of engineering construction.Meanwhile, the writer puts forward the idea that in the three stages of first-phase preparations, project construction, and completion test, we should pay adequate attention to the eight links: market access and clearing, project planning and approval, project bidding, quality security system, project design alteration and fund appropriation, technical and procedural completion test. What's more, the writer is in favor of raising the discovery rate and punishing rate of the commercial briberies, increasing the cost of commercial briberies, in order to restrict the briberies to a bare minimum.
