The patent system is one of the oldest written intellectual property systems. Its purpose is to ensure that the inventor of creative activities has a certain number of returns, and to encourage the invention works. From a worldwide perspective, the patent system has played a tremendous role in the promotion of scientific and technological progress and economic development, and the operation of the patent system also shows that a country's patent system operating efficiency directly affects the level of its scientific and technological progress and the level of economic development. The "11th Five-Year" plan clearly stipulated the next step to encourage independent innovation as the focus, as one of the most important way to protect its operating efficiency for independent innovation; the patent system has a decisive influence. Therefore this study has certain theoretical and practical significance.For an in-depth study on the operation of China's patent system performance, we take theoretical research and empirical studies combining method. First introduced the definition of patent system and the course of patent system's operation and related theories, then discussed the patent development of the United States, Japan and Korea respectively, and through the patent system differences of USA, Japan and other countries in operating mechanism, drew the inspiration on China's patent development. Based on this, this paper identified the impact of the patent system operating performance factors and operating performance of the patent system evaluation methods, namely: from innovation performance and economic performance, the method of innovation performance evaluation is principal component analysis and cluster analysis. Using the data from 1985 to 2005, with the selection of the 19 indicators, this paper analyzed innovative performance, the evaluation of economic performance mainly used The Solow economic growth model and cluster analysis method. And the conclusion is: China's patent system reform is essential for improving the economic performance of the patent system is not obvious role, but there is a significant performance on innovation performance. At last the paper concluded the problems in China's patent operation system, and gave some proposed countermeasures for improve our operating performance of the patent system and looks forward to the developing direction of this field in future.
