Intellectual Property Protection And Technology Transfer

In the technology transfer of Multi-National Company (MNC), there's externality, which means technology spillover effect. The imitation competition behaviors of enterprise and the legislation on intellectual property right protective policy of government in host country has got far-reaching impact on technology transfer of MNC. This thesis gives high light on the investigation of MNC how to choose the best mode of technology transfer and the transferred technology level under the threat of imitation competition behavior of enterprise in host country. After that, the effect of the technology transfer on the improving of technology and social welfare in host country is analyzed.Integrating theory with practice, innovations has been made on the two following points:(1) Set up an improved mathematical model on the basis of former research. The improvement is shown in the two following points: firstly, technology spillover reflects the intellectual property right protection intension in host country; secondly, analyzing the relationships between IPR policies (intellectual property right) in host country and the Research and Development (R&D) efficiency of MNC.(2) Considering the current situation of intellectual property right protection and technology developing level, verify the effect of intellectual property right protection on the improvement of technology level in China.The main conclusion that this thesis gets is as follows: first, besides intellectual property right protection intension in host country, R&D efficiency of MNC can also influence its technology transfer strategy; second, social welfare level don't change with the monotonic change of intellectual property right protection intension in host country; third, at present, the technology advancing in China is mainly by the way of imitating advanced technology in developed countries. Tighten intellectual property right protection will restrain technology spillover, and then, influence the technology improving in China. The research on the effect of property right protection on the technology transfer of MNC in this paper provides certain theoretical foundation for the establishment of proper intellectual property right protective policy in developing countries.
