Drug advertisement serves as a fast and efficient way to promote sale of medicines, as well as introduces drug information to physicians, pharmacists and patients. Important information such as drugs'ingredients, indications, functions, usage, contraindications, adverse drug reactions, and precautions helps customers in using drug properly. The Drug Administration Law and the Advertisement Law of the People's Republic of China have established regulatory requirements for commercial drug advertisement. However, we noticed that illegal and misleading advertisement still exists in the drug advertisement market. Illegal or misleading drug advertisements not only become a heavy burden for the patients, but also threat the public health and construction of harmonious society. Misleading drug advertisements are much more harmful than the commercial advertisement of ordinary merchandises because of the usage of drug directly affect people's life. It happened more often due to the asymmetry distribution of drug information between seller and customer. This study will address the investigation results in how to monitor and guide the drug advertisement, make it not only an efficient way for drug promotion, but also a proper way to facilitate the correct usage of medicines in the public. As an urgent social problem in details, this study summarizes the functions, specialty and importance of drug advertisement. The author also introduces the experience and regulatory of drug administration of developed countries and managing drug advertisement, analyzes the difference between the current regulatory situation in China and discuss the causes of illegal and misleading drug advertisements. Based on the comparison of the successful drug advertisement administration experience of developed countries such as the United States and on the author's personal experience in eliminating illegal and misleading drug advertisements in Xiamen, the author analyzed the five main factors contribute to illegal advertisements. They are existence of regulatory holes and non-clarified agent responsibilities, the separation of approval rights and inspection rights of agencies, incompletion of the administration system, lack of legal punishment, lack of strictness of media administration. The author then illustrated the significance of performing drug advertisement administration, and posed a series of viewpoints, which mainly focused on the improvement of the policies, regulations and evaluations of performance of the drug advertisement management system in China. In order to strengthen drug advertisement administration, protect the public health and develop pharmaceutical industry, this thesis made recommendations on how to innovate in management system and technique, unify the authority, responsibilities and legal liabilities, how to establish a systemic regulation network in local government, communicate among agencies, strengthen punishment policies, and distribute responsibilities among manufacturers, distributors, medical providers, mass media and other related organizations, and how to educate the public to protect their legitimate rights and interests.
