| China is the origin of Chinese medicine. Chinese medicine industry has developed well and become a stronger industry in our society after the reform and opening policy. With the increase of environmental protection and the lack of chemical medicines, the developed countries have begun to pay attention to Chinese medicine. With the help of their advanced techniques and experience of operating intellectual property, they have got the intellectual property after refining and making use of the traditional knowledge in developing countries. The protective awareness to the intellectual property is weak and the protective system to the intellectual property is not perfect in China now, so there is a serious drain on the intellectual property of Chinese medicine and a severe situation for Chinese medicine.In order to retain and develop the traditional advantage of Chinese medicine, the State Council has declared a very important document-- Outline for the Development of Chinese medicine modernization, which set up the strategic position of Chinese medicine in the construction of our economy. But in terms of Chinese medicine modernization, people pay more attention to how to apply the new norms and new techniques to Chinese medicine and are ignorant of the intellectual property role in Chinese medicine modernization.This article will discuss the protection of intellectual property and Chinese medicine modernization from the developing of Chinese medicine industry. First it will give a general statement on protection of intellectual property and Chinese medicine modernization and summarize the forms and range of intellectual property for Chinese medicine. It will also analyze the present situation and shortage about the protection of intellectual property for Chinese medicine and point out the significance of strengthening intellectual property protection for Chinese medicine. Finally, it will put forward the solutions for it and the suggestions for perfecting its protective forms. |
