But, due to the domestic enterprises lack of consciousness of intellectual property rights, which leads to our country intellectual property of traditional Chinese medicines by foreign repeatedly stealing, traditional Chinese medicine intellectual property loss is serious. State Intellectual Property Office released a set of data:Although China is a big country of Chinese herbal medicine, there are nearly a thousand kinds of Chinese herbal medicine has been patented by foreign companies. Faced with foreign pharmaceutical companies eye covetously, as competitors of Chinese medicine market, Chinese enterprises must recognize our intellectual property management from a strategic height and attention to protecting the company's intellectual property.To find the short board of current intellectual property rights of Chinese enterprises management, and enhance the level of intellectual property management, in this study, we subjects well-known Chinese enterprises, and intellectual property management theory, enterprise strategy management theory and the theory of enterprise competitiveness, use literature research, comparative analysis, theoretical analysis and empirical research method of combining, etc. We analysis and research on A company's intellectual property management in depth, and got the following research conclusions:1. Japan and South Korea and other countries started earlier in the proprietary intellectual property protection, improve the system, pharmaceutical companies are very strong awareness of IPR protection, and the importance of international patent portfolio. Pharmaceutical companies in developed countries as the United States, Britain and other aspects of the patent herbal accelerate layout. In contrast, Chinese enterprises are weaked awareness of IPR protection, and can't form system of intellectual property management system, which is a huge intellectual property risks.2. Through the investigation and analysis of A company main product patents and intellectual property management situation, it is concluded that A company mainly face the following problems:(1) A company is relatively weak consciousness of intellectual property rights; (2) A company isn't perfect in terms of intellectual property system; (3) A company's Intellectual property managers are inadequate staffing.3. Summarized the develop the characteristics of pharmaceutical companies' intellectual property and the route of the traditional Chinese medicine research and development process to obtain IP. And then, we analysis from the perspective of intellectual property protection steps and policy, the Chinese enterprises building intellectual property protection management system, also we proposed a variety of intellectual property rights applicable to Chinese enterprises operation and management mode, such as commercial mode of operation, the patent pool model patents paid transfer mode, and intellectual property cross-licensing model hosted mode.4. Combined with A company development situation and the implementation of intellectual property, on the main problem of A enterprise intellectual property management, we put forward the corresponding countermeasures, including higher intellectual property development capabilities, strengthen the consciousness of intellectual property rights (IPR) protection, improve the operational ability of IPR, institutionalized management to strengthen IPR and strengthen the construction of intellectual property talent.
